These Terms of Service ("Terms") govern the use of the website waveatmos.com and the purchase of digital products from Jonathan Blank & Tobias Lunkwitz GbR ("WaveAtmos", "we", "us", or "our"). By accessing our website or purchasing our products, you agree to these Terms.
1. Scope and Contractual Partner

2. Conclusion of Contract
2.1 The presentation of products in the online store does not constitute a legally binding offer, but an invitation to order. 2.2 By clicking the final "Buy Now" or "Complete Purchase" button in the checkout process, you place a binding order for the items in your shopping cart. 2.3 The contract is concluded when we send you an order confirmation and the download link for the digital products via email.
3. Prices and Payment
3.1 All prices are final prices. Depending on your location, prices may include applicable Value Added Tax (VAT). 3.2 Payment is due immediately upon conclusion of the contract. We offer various payment methods (e.g., Credit Card, PayPal), which are displayed during the checkout process. 3.3 Digital products will only be made available once the payment has been successfully processed.
4. Delivery of Digital Content
4.1 The products (vocal chains, templates, presets) are delivered exclusively as digital downloads. No physical media will be shipped. 4.2 After a successful transaction, you will receive an email with a download link or access to a customer portal. It is your responsibility to ensure you have a compatible DAW and the required third-party plugins as specified on the product pages.
5. Right of Withdrawal
5.1 As a consumer within the European Union, you have a statutory 14-day right of withdrawal. 5.2 Details regarding the exercise of this right, the timeframe, and the consequences of withdrawal are governed by our Refund Policy, which is an integral part of these Terms.
6. Usage Rights (EULA)
6.1 The purchase of our products grants you a license to use the sounds and templates. 6.2 The specific scope of these usage rights, including the royalty-free status and installation limits, is governed exclusively by our End User License Agreement (EULA).
7. Limitation of Liability
7.1 WaveAtmos is liable for damages caused by intent or gross negligence. For simple negligence, WaveAtmos is only liable for the breach of essential contractual obligations (cardinal obligations). 7.2 We are not liable for technical issues arising from third-party software (DAWs, plugins), hardware incompatibilities, or loss of data due to improper installation. 7.3 Total liability for any claim arising under these Terms is limited to the amount paid for the product in question.
8. Final Provisions
8.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). 8.2 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 8.3 The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
